THE POLITICAL DYNAMIC OF WAQF LAW IN INDONESIA

Abstract

Waqf as one of Islamic philanthropy that should be able to improve the welfare of the society. Thus,
the existence of waqf needs to be regulated in a legal system in accordance with the the current
development. In this regard, the political dynamic of waqf law in Indonesia has undergone the various
changes which are very significant to be discovered comprehensively so that it becomes a
consideration for the development of waqf law in the future. Waqf in Indonesia has undergone stages
of development starting from before and after the entry of Islam in the Archipelago, the period of
Dutch colonial, the early period of independence and the period of new order, as well as the period
after the issuance of waq law in 2004. The study finds ou that there was a political dynamics of waqf
law in each of those periods. Some critical studies of the rules of waqf law can be used as thoughts of
legal reform and empowerment of waqf in Indonesia that are better and in accordance with the
development of science and technology, thereby, waqf can really improve economic welfare and ease
the society life in any case
